The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
April 2012 - Code a00310 (appeal dismissed):
- Where an existing outbuilding would be enlarged, then the whole of the resulting structure (i.e. not only the additional part) should be assessed against E.1(e). [Note: In other words, the phrase “the building, enclosure or container” applies to the whole of the resulting structure]. (*)
- For example, where an existing outbuilding is within 2m of a boundary and has height greater than 2.5m, then a proposed extension to this outbuilding would not comply with E.1(e) even if the proposed extension would not (in itself) be within 2m of a boundary or would not (in itself) have height greater than 2.5m. (*)
April 2012 - Code a00309 (appeal dismissed):
- This appeal decision provides an example of where a property has two rear-facing walls, one of which is directly to the rear of the other, and the Inspector concluded that the innermost rear-facing wall forms part of “the rear wall”. [Note: The Inspector didn’t comment on whether the outermost rear-facing wall also forms part of “the rear wall”].
- It’s incorrect to take the approach that an extension must either be a “side extension” or a “rear extension”, and then to apply either A.1(j) or A.1(f)/A.1(g)/A.1(h) respectively. Where an extension would extend beyond both an original side wall and an original rear wall, then both A.1(j) and A.1(f)/A.1(g)/A.1(h) will be applicable.
- Where the width of a property varies, the “width of the original dwellinghouse” should be calculated at its widest point.
