The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation (0 "LDC Appeals" and 4 "Enforcement Appeals"), for which the conclusions are as follows:

January 2013 - Code e2013-002 (ground (c) dismissed):

  • Where a platform and balustrade form a single structure, then both the platform and the balustrade are subject to the 300mm height limit.

April 2012 - Code e2012-005 (ground (c) allowed):

  • It is possible under Part 1 of the GPDO for two neighbouring properties to each concurrently erect a structure that adjoins the other structure across the boundary.
  • Where works exceed the tolerances of permitted development during the construction process, but have not been substantially completed, it is possible to alter the works so that they become permitted development.

March 2012 - Code e2012-004 (ground (c) dismissed):
