The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 7 additional appeal decisions relating to householder permitted development legislation (1 "LDC Appeal" and 6 "Enforcement Appeals"), for which the conclusions are as follows:

March 2013 - Code a00379 (appeal allowed):

  • This appeal decision provides an example of the types of factors that should be taken into consideration when determining which elevation is “the principal elevation”.
  • “The principal elevation” is not necessarily the elevation that contains the main entrance door.
  • This appeal decision provides an example of where it was concluded that a particular elevation does not “front” a highway, noting that the elevation and the highway are separated either by a significant distance or by land in different ownership or use.
  • If an applicant does not provide information as to whether a proposed development would comply with the conditions of a Class, then an LDC should be issued. (*)
  • For example, if the applicant does not specify whether the new upper-floor side windows would be obscure-glazed and non-opening, then an LDC should be issued. (*)

August 2012 - Code e2012-018 (ground (c) dismissed):

  • This appeal decision provides an example of where it was concluded that decking should be assessed against either Class A or Class E. (*)

August 2012 - Code e2012-017 (ground (c) dismissed):

  • For the purposes of the GPDO, the term “microwave” means that part of the radio spectrum above 1,000 MHz.
