The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation (0 "LDC Appeals" and 5 "Enforcement Appeals"), for which the conclusions are as follows:

October 2012 - Code e2012-023 (ground (c) dismissed):

  • This appeal decision provides an example of where it was concluded that a structure that abuts the main house (i.e. without a gap) should be assessed against Class A (i.e. rather than Class E).

September 2012 - Code e2012-022 (ground (c) dismissed):

  • The term “eaves” does not apply to the top of a parapet wall.
  • Where development is undertaken as a single operation, then it is not possible for only part of the development to be permitted development (i.e. either the entire development is permitted development, or none of the development is permitted development). (*)
  • Where development is undertaken as a single operation, then it is not possible for part of the development to be permitted development and the other part to be granted planning permission by the LPA. (*)
  • Where a proposed extension would be attached to an existing extension, then the phrase “the enlarged part of the dwellinghouse” applies to only the proposed extension. [Note: In other words, only the proposed extension should be assessed against those limitations and conditions of Class A that apply to the enlarged part of the dwellinghouse]. (*)
