The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 1 additional appeal decision relating to householder permitted development legislation (0 "LDC Appeals" and 1 "Enforcement Appeal"), for which the conclusions are as follows:
June 2013 - Code e2013-012 (ground (c) dismissed):
- Where the rear wall of an extension would comply with the 3m/4m rear projection limit of A.1(f), but the eaves / guttering / soffit / fascia / etc of the extension would slightly overhang this line, then this would be permitted development.
- Where (most of) the rear wall of an extension would comply with the 3m/4m rear projection limit of A.1(f), but the rear ends of the side walls would project beyond this line, then this would not be permitted development.
- This appeal decision provides an example of where it was concluded that red bricks (on the walls of a single storey rear extension) would not be “of a similar appearance” to light-grey smooth render (on the walls of the main house).
