The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation (2 "LDC Appeals" and 3 "Enforcement Appeals"), for which the conclusions are as follows:

July 2013 - Code e2013-021 (ground (c) dismissed):

  • A roof terrace (with a balustrade) does constitute a “verandah, balcony or raised platform”. [Note: The phrase “roof terrace” is referring to the roof of a structure that extends downwards (e.g. to ground level), rather than a platform that’s cantilevered above an open space]. (*)

July 2013 - Code e2013-020 (ground (c) allowed in part):

  • Where it’s proposed to erect a two-storey rear extension, the restrictions of A.1(h) would apply to both storeys. (*)
  • For example, it is not possible (on a detached property) to erect (as a single operation) a two-storey rear extension that has a ground floor with length greater than 3m and a first floor with length up to 3m. (*)
  • This appeal decision provides an example of where it was concluded that light-red bricks (on the walls of a two-storey rear extension) would be “of a similar appearance” to dark-red bricks (on the walls of the main house).
