SHORT SUMMARY:
- At present, the demolition of an unlisted (etc) building in a conservation area requires conservation area consent. Where someone carries out such demolition without conservation area consent, this is an offence (for which they can be prosecuted). Furthermore, such demolition does not become immune from requiring conservation area consent via the passage of time.
- From 01/10/2013 onwards, the demolition of an unlisted (etc) building in a conservation area will require planning permission (but will no longer require conservation area consent). Where someone carries out such demolition without planning permission, this will be an offence (for which they can be prosecuted). Furthermore, such demolition will not become immune from requiring planning permission via the passage of time.
