The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation (3 "LDC Appeals" and 2 "Enforcement Appeals"), for which the conclusions are as follows:
September 2013 - Code a00409 (appeal allowed):
- The height of a structure should be measured from the highest part of the adjacent ground level (i.e. rather than from each part of the adjacent ground level). (*)
September 2013 - Code a00408 (appeal dismissed):
- For the purposes of the 01/10/2008-14/04/2015 versions of Part 1 of the GPDO, the term “highway” means a way over which members of the public have the right to pass and repass.
- The term “highway” does apply to a public footpath.
September 2013 - Code e2013-026 (ground (c) dismissed):
