The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation (3 "LDC Appeals" and 1 "Enforcement Appeal"), for which the conclusions are as follows:

October 2013 - Code a00412 (appeal dismissed):

  • Where the roof of the extension would have the same angle as, but a different orientation to, the roof of the original house, then this would comply with A.3(c).
  • This appeal decision provides an example of where it was concluded that the roof pitch of the extension would not be the same as the roof pitch of the original house.
  • This appeal decision provides an example of where the Inspector did not accept the applicant’s argument that it wouldn’t be “practicable” for the roof pitch of the extension to be the same as the roof pitch of the original house.

September 2013 - Code e2013-027 (ground (c) dismissed):

  • This appeal decision provides an example of the types of factors that should be taken into consideration when determining which elevation is “the principal elevation”.
