IMPORTANT: 20 “Prior Approval Appeals” have been added to the “Part 1 of the GPDO – Appeal Decision Summaries” document …

20 appeal decisions relating to applications for prior approval under Part 1 of the GPDO have now been added to the "Part 1 of the GPDO - PRIOR APPROVAL Appeal Decisions" document on this website. These 20 appeals cover the period from 13/09/2013 to 14/11/2013, and should represent almost all (if not all) such appeals that have been determined so far.

The conclusions of these 20 appeals are listed within the new "Notification and prior approval process" topic within the above document.  As always, within the above document members can view the full details of all of these appeals (including the appeal decision notices) for no extra cost.  In addition, a summary of these conclusions is provided below:

Please note the following:

  • The conclusions of these first 20 appeals contain a number of contradictions.  As such, it’s not the case that these 20 appeals enable members to know for certain how to interpret all of the issues. Instead, these 20 appeals enable members to choose the most appropriate interpretation, and to support this interpretation with appeal decisions, which is particularly important if the other party has submitted appeal decisions that support the opposite interpretation.
