“Part 1 of the GPDO – Appeal Decision Summaries” – 5 additional appeal decisions (total = 507 + 29) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document and the Part 1 of the GPDO - PRIOR APPROVAL Appeal Decisions document have been updated to include 5 additional appeal decisions relating to householder permitted development legislation (3 "LDC Appeals", 0 "Enforcement Appeals", and 2 "Prior Approval Appeals"), for which the conclusions are as follows:

December 2013 - Code a00432 (appeal dismissed):

  • Where a Class A extension would have a roof that would join onto the roof of the main house (and in the case where it would be assessed against Class B), then this appeal decision provides an example of how to calculate the volume (i.e. “cubic content”) for the purposes of B.1(d).
  • Where a Class A extension would have a roof that would join onto the roof of the main house (and in the case where it would be assessed against Class B), then for the purposes of B.1(d) the volume (i.e. “cubic content”) of the whole of the roof of the extension should be taken into consideration, rather than the volume of only the dormers (or similar projecting structures) within the roof of the extension. (*)
  • To comply with the phrase “a porch outside any external door of a dwellinghouse”, it is necessary for the external door to continue to exist (i.e. as an internal door) after the works are substantially completed. [Note: In other words, it is not possible (as a single operation) to erect a porch (e.g. under Class D) outside an existing door and to remove this existing door (e.g. as works not requiring PP)].

December 2013 - Code a00431 (appeal dismissed):

  • If an applicant does not provide information as to whether a proposed development would comply with the conditions of a Class, then an LDC should be refused. (*)
  • For example, if the applicant does not specify what materials would be used, then an LDC should be refused. (*)
