The Part 1 of the GPDO - GENERAL Appeal Decisions document and the Part 1 of the GPDO - PRIOR APPROVAL Appeal Decisions document have been updated to include 6 additional appeal decisions relating to householder permitted development legislation (4 "LDC Appeals", 1 "Enforcement Appeal", and 1 "Prior Approval Appeal"), for which the conclusions are as follows:

"LDC APPEALS" AND "ENFORCEMENT APPEALS":

January 2014 - Code e2014-001 (ground (f) dismissed after considering the fallback position):

  • A C4 house in multiple occupation (i.e. a “small HMO”) does benefit from Part 1 of the GPDO. (*)

January 2014 - Code a00446 (appeal allowed):

  • Where a proposed extension would be attached to an existing extension, then the phrase “the enlarged part of the dwellinghouse” applies to only the proposed extension. [Note: In other words, only the proposed extension should be assessed against those limitations and conditions of Class A that apply to the enlarged part of the dwellinghouse]. (*)
