The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document and the "GPDO Part 1 Class A (Larger Rear Extensions) - Prior Approval Appeal Decisions" document have been updated to include 5 additional appeal decisions relating to householder permitted development legislation (3 "LDC Appeals", 1 "Enforcement Appeal", and 1 "Prior Approval Appeal"), for which the conclusions are as follows:

"LDC APPEALS" AND "ENFORCEMENT APPEALS":

January 2014 - Code a00451 (appeal dismissed):

  • More than one wall facing the same direction can be “a wall forming a side elevation” (in the case where the elevation is staggered horizontally).
  • The side wall of an original (part-width) rear projection (i.e. the side wall facing the infill area) is “a wall forming a side elevation”. (*)
  • For example, an extension to the side of an original (part-width) rear projection where the extension has a width greater than half the width of the original house is not permitted development. (*)
  • For example, an extension to the side of an original (part-width) rear projection where the extension exceeds 4m in height is not permitted development. (*)
  • For example, an extension to the side of an original (part-width) rear projection where the extension has more than a single storey is not permitted development. (*)
  • In the second of the above diagrams, “Extension D” would be subject to the “extend beyond” type restrictions in relation to “Wall 2”. [Note: The diagrams are viewable within the “Extend beyond” topic of this document].
  • This appeal decision provides an example of where it was concluded that significant weight should be attached to the advice within the DCLG “Permitted development rights for householders - Technical Guidance” document. (*)
