“Part 1 of the GPDO – GENERAL Appeal Decisions” – 4 additional appeal decisions (total = 589) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation (2 "LDC Appeals" and 2 "Enforcement Appeals"), for which the conclusions are as follows:

October 2014 - Code e2014-016 (ground (c) allowed):

  • Where an existing outbuilding would be enlarged, then only the additional part (i.e. not the whole of the resulting structure) should be assessed against E.1(e). [Note: In other words, the phrase “the building, enclosure or container” applies to only the additional part]. (*)
  • For example, where an existing outbuilding is within 2m of a boundary and has height greater than 2.5m, then a proposed extension to this outbuilding would comply with E.1(e) so long as the proposed extension would not (in itself) be within 2m of a boundary or would not (in itself) have height greater than 2.5m. (*)

September 2014 - Code a00497 (appeal allowed):

  • This appeal decision provides an example of where it was concluded that decking should be assessed against Class E (i.e. rather than Class A). (*)
  • The height of a structure should be measured from the highest part of the adjacent ground level (i.e. rather than from each part of the adjacent ground level). (*)
  • When measuring the height of a structure, “ground level” means natural ground level.

September 2014 - Code a00496 (appeal dismissed):

September 2014 - Code e2014-015 (ground (c) dismissed):
