The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 6 additional appeal decisions relating to householder permitted development legislation (6 "LDC Appeals" and 0 "Enforcement Appeals"), for which the conclusions are as follows:
October 2014 - Code a00505 (appeal dismissed):
- Class A does allow an extension with a roof that would join onto the roof of the main house. (*)
- This appeal decision provides an example of where it was concluded that a Class A extension with a roof that would join onto the roof of the main house should also be assessed against Class C (without applying the 15cm projection limit of C.1(b)) and not Class B. (*)
- Where a proposed extension would be attached to an existing extension, then the phrase “the enlarged part of the dwellinghouse” applies to the combined structure. [Note: In other words, the combined structure should be assessed against those limitations and conditions of Class A that apply to the enlarged part of the dwellinghouse]. (*)
- Furthermore, the above conclusion still applies even if the existing extension was granted planning permission by the LPA (i.e. rather than erected under government permitted development rights). (*)
- This appeal decision provides an example of where it was concluded that significant weight should be attached to the advice within the DCLG “Permitted development rights for householders - Technical Guidance” document. (*)
October 2014 - Code a00504 (split decision):
- This appeal decision states, or implies, that the successful completion of the prior approval process is not legally equivalent to confirmation that the proposed development would be lawful (i.e. confirmation that it would comply with all of the other limitations and conditions of Part 1 Class A). (*)
