New Legislation – relating to National Park Authorities (01/07/2015) …

The following 1 new Statutory Instrument (SI) comes into force on 01/07/2015:

New Legislation:

  • July 2015: SI 2015 No. 770 - The National Park Authorities (England) Order 2015 (pdf) (link).

  • The above SI 2015 No. 770 is not summarised on the Planning Jungle website.
  • Note: The "Explanatory Memorandum" to the above SI 2015 No. 770 states that the purpose of the above SI is to consolidate the following 6 previous SIs:
    - SI 1996 No. 1243 - National Park Authorities (England) Order 1996 (link).
    - SI 1996 No. 2546 - National Park Authorities (England) (Amendment) Order 1996 (link).
    - SI 2006 No. 3165 - National Park Authorities (England) Order 2006 (link).
    - SI 2009 No. 557 - National Park Authorities (Amendment) (England) Order 2009 (link).
    - SI 2009 No. 837 - The Local Government (Structural Changes) (Miscellaneous Amendments and Other Provision) Order 2009 (link).
    - SI 2014 No. 571 - The National Park Authorities (England) (Amendment) Order 2014 (link).
  • Note: Article 12 of the above SI 2015 No. 770 revokes 4 of the above 6 previous SIs (i.e. SI 1996 No. 1243, SI 1996 No. 2546, SI 2009 No. 557, and SI 2014 No. 571), but not the other 2 SIs (i.e. SI 2006 No. 3165 and SI 2009 No. 837).
  • Note: The above SI 2015 No. 770 does not incorporate the following 2 SIs:
    - SI 2005 No. 421 - The New Forest National Park Authority (Establishment) Order 2005 (link).
    - SI 2010 No. 497 - The South Downs National Park Authority (Establishment) Order 2010 (link).
  • Note: Although the "Explanatory Memorandum" to the above SI 2015 No. 770 refers to the "consolidation" of the legislation, it should be noted that there are also a number of amendments to the legislation. For example, Schedule 5 paragraph 12 of the previous SI 1996 No. 1243 stated that the LBCA Regulations 1990 shall apply as if "in regulation 9(1) ... after the word “borough” there were inserted “or National Park authority”", whereas Schedule 3 paragraph 10 of the above SI 2015 No. 770 states that the LBCA Regulations 1990 shall apply as if "the reference in regulation 9(1) ... to the council of a district included reference to a National Park authority". As stated above, the above SI 2015 No. 770 is not summarised on the Planning Jungle website, and therefore we're unable to advise whether any of the amendments are significant.
