“Part 1 of the GPDO – GENERAL Appeal Decisions” – 13 additional appeal decisions (total = 634) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 13 additional appeal decisions relating to householder permitted development legislation (9 "LDC Appeals" and 4 "Enforcement Appeals"), for which the conclusions are as follows:

March 2015 - Code a00528 (appeal dismissed):

  • This appeal decision provides an example of where it was concluded that a particular piece of land is not within the “curtilage” of the property.

March 2015 - Code e2015-008 (ground (c) dismissed):

  • The excavation of a basement does not fall within the scope of Class A if the works do involve engineering operations.
  • It is not possible for works that involve engineering operations to fall within the scope of Part 1 of the GPDO. (*)
  • This appeal decision provides an example of where it was concluded that the excavation of a certain volume of earth (i.e. as part of other works) does not fall within the scope of Part 1 of the GPDO. (*)

March 2015 - Code e2015-007 (ground (c) dismissed):

  • For the purposes of the 01/10/2008-14/04/2015 versions of Part 1 of the GPDO, the term “highway” means a way over which members of the public have the right to pass and repass.
  • For the purposes of the 01/10/2008-14/04/2015 versions of Part 1 of the GPDO, the term “highway” can apply to a cul-de-sac.
  • For the purposes of the 01/10/2008-14/04/2015 versions of Part 1 of the GPDO, the term “highway” can apply to an unadopted road (i.e. a “private” road that’s not maintainable at the public expense).
  • For the purposes of the 01/10/2008-14/04/2015 versions of Part 1 of the GPDO, this appeal decision provides an example of where it was concluded that a particular way or piece of land is a “highway”.
