“Part 1 of the GPDO – GENERAL Appeal Decisions” – 10 additional appeal decisions (total = 676) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 10 additional appeal decisions relating to householder permitted development legislation (10 "LDC Appeals" and 0 "Enforcement Appeals"), for which the conclusions are as follows:

July 2015 - Code a00570 (appeal dismissed):

  • E.3 only prevents an outbuilding from being within the area that’s directly in between the side wall of the house and the side boundary. [Note: In other words, E.3 does not prevent an outbuilding from being within the additional area that can be covered if considering the imaginary line of the side wall when extended forwards and rearwards].
  • For a property within a conservation area (or other article 2(3) land), where an outbuilding would not be in between the side wall of the house and the side boundary, but the doors of the outbuilding would open outwards and slightly overhang this line, then this would not be permitted development.

July 2015 - Code a00569 (appeal allowed):

  • This appeal decision provides an example of the types of factors that should be taken into consideration when determining which elevation is “the principal elevation”.

July 2015 - Code a00568 (appeal allowed):

  • For the purposes of the post-06/04/2014 versions of B.2(b), the 20cm set back should be measured from the outer edge of the eaves.
