“Part 1 of the GPDO – GENERAL Appeal Decisions” – 4 additional appeal decisions (total = 760) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

February 2016 - Code a00654 (appeal dismissed):

  • The term “eaves” does not apply to the roof of a dormer.
    [Note: Inspector concluded that “the height of the eaves of the existing dwellinghouse” referred to in A.1(d) does not apply to the flat roof of an existing dormer].
  • More than one wall facing the same direction can be “a wall forming a side elevation” (in the case where the elevation is staggered horizontally).
  • This appeal decision provides an example of where a property has a side-facing wall within an original inset area that’s recessed in relation to certain surrounding elements including a roof or floor above, and the Inspector concluded that this wall is “a wall forming a side elevation”.
    [Note: Area is recessed in relation to roof above, wall to side, and pillar in front].
  • This appeal decision provides an example of where it was concluded that a relatively short width of wall is “a wall forming a side elevation”.
    [Note: The wall is single storey, and has a width of approx 1.2m].
  • In the second of the above diagrams, “Extension D” would be subject to the “extend beyond” type restrictions in relation to “Wall 2”. [Note: The diagrams are viewable within the “Extend beyond” topic of this document].
    [Note: This appeal decision relates to “a wall forming a side elevation”].

February 2016 - Code a00653 (appeal dismissed):

  • Where there’s an existing (non-original) extension with a roof that joins onto the roof of the main house, then this existing extension does reduce the volume (i.e. “cubic content”) that remains under B.1(d) for further extensions.
