“Part 1 of the GPDO – GENERAL Appeal Decisions” – 5 additional appeal decisions (total = 770) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

February 2016 - Code a00664 (appeal dismissed):

  • The phrase “dual-pitched roof” does not apply to an outbuilding with a mansard / crown type roof (i.e. either a roof with shallow pitches in the centre and steeper pitches at the sides, or a roof with a flat area in the centre and pitches at the sides). (*)

February 2016 - Code a00663 (appeal dismissed):

  • For the purposes of A.1(b) and E.1(b), a basement extension under the garden does count towards “the total area of ground covered by buildings, enclosure and containers”. [Note: In other words, a basement extension under the garden does use up some (or all) of the 50% limit, even though it’s not on top of the ground].
    [Note: Concrete roof of basement is approx 1m below the rear garden].
  • This appeal decision provides an example of where it was concluded that the development would be contrary to a (general) condition on a previous planning permission. [Note: This conclusion relates to a condition that doesn’t directly remove permitted development rights].
    [Note: The condition requires an approved landscaping scheme to be carried out].
