The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 7 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
June 2016 - Code a00702 (appeal dismissed):
- For the purposes of the post-15/04/2015 version of Part 1 of the GPDO, this appeal decision provides an example of where it was concluded that a particular way or piece of land is a “highway”.
[Note: Unadopted way providing vehicular access to front of properties. The way is subject to a section 106 agreement that provides for its continuous, unrestricted use by the public, subject to an entitlement to close it 1 day a year to preclude it from becoming a public highway]. - For the purposes of the post-15/04/2015 version of Part 1 of the GPDO, the term “highway” means a way over which members of the public have the right to pass and repass.
June 2016 - Code a00701 (appeal dismissed):
- This appeal decision provides an example of where it was concluded that a particular structure is not part of the “dwellinghouse”.
[Note: Relates to Part 1 Class A paragraph A.1(j) of the GPDO 2015].
[Note: Structure is a single storey garage, which is separated from the main house by a gap, except for being linked by a boundary treatment].
