“GPDO Part 1 (All Classes) – LDC Appeal Decisions” – 2 additional appeal decisions (total = 826) …

The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 2 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

July 2016 - Code a00720 (appeal allowed):

  • Where a property has eaves at different levels, the “height of the eaves of the existing dwellinghouse” referred to in A.1(d) is the highest eaves level. (*)
  • This appeal decision provides an example of where a structure consists of a vertical wall, above which is a steep pitch, above which is a shallow pitch (i.e. a mansard type design), and the Inspector concluded that the term “eaves” does apply to the edge between the vertical wall and the steep pitch.
    [Note: Steep pitch is approx 80 degrees, shallow pitch is approx 45 degrees].
  • This appeal decision provides an example of where a structure consists of a vertical wall, above which is a steep pitch, above which is a shallow pitch (i.e. a mansard type design), and the Inspector concluded that the term “eaves” does apply to the edge between the steep pitch and the shallow pitch.

  • Class A does allow an extension with a roof that would join onto the roof of the main house. (*)
  • This appeal decision provides an example of where it was concluded that a Class A extension with a roof that would join onto the roof of the main house should also be assessed against Class B, albeit as well as Class C (without applying the 15cm projection limit of C.1(b)). (*)
    [Note: Roof of extension does not contain a habitable room, albeit that the first floor level of the extension is at the same level as the lower part of the cat-slide roof of the main house].
  • This appeal decision provides an example of where it was concluded that a particular roof extension would constitute “an enlargement which joins the original roof to the roof of a rear or side extension” for the purposes of B.2(b).
    [Note: Roof of proposed two-storey rear extension would join onto the roof of the main house].
