“Part 1 of the GPDO – GENERAL Appeal Decisions” – 8 additional appeal decisions (total = 856) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 8 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

October 2016 - Code a00750 (appeal dismissed):

  • The height of a structure should be measured from the highest part of the adjacent ground level (i.e. rather than from each part of the adjacent ground level). (*)
    [Note: The structure is an extension].
  • Where the front part of an extension is offset from the rear part of the extension, such that the left-most point of the extension is not directly to the side of the right-most point of the extension, then the “width” of the extension is the distance (measured in a sideways direction) between the left-most point of the extension and the right-most point of the extension (i.e. rather than the distance directly across the single widest part of the extension).
    [Note: Front part of the extension has width approx 4.35m, rear part of the extension has width approx 5.75m, and front part is offset from rear part by approx 2.05m.  Inspector concluded that the “width” of the extension is 5.75m + 2.05m = 7.8m (i.e. rather than 5.75m)].

October 2016 - Code a00749 (appeal dismissed):

  • A flat does not benefit from Part 1 of the GPDO.
  • This appeal decision provides an example of where it was concluded that a particular property is a “flat”, rather than a “dwellinghouse”, for the purposes of Part 1 of the GPDO.
    [Note: Part of the property is above a shared vehicular accessway].

October 2016 - Code a00748 (appeal dismissed):

  • Where there’s an existing (non-original) extension with a roof that joins onto the roof of the main house, then this existing extension does reduce the volume (i.e. “cubic content”) that remains under B.1(d) for further extensions.
