“Part 1 of the GPDO – GENERAL Appeal Decisions” – 5 additional appeal decisions (total = 908) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

February 2017 - Code a00802 (appeal allowed):

  • The excavation of a basement does fall within the scope of Class A.
  • This appeal decision provides an example of where it was concluded that the excavation of a certain volume of earth (i.e. as part of other works) does fall within the scope of Part 1 of the GPDO. (*)
    [Note: Approx 230m3 would be excavated during creation of basement].

February 2017 - Code a00801 (appeal dismissed):

  • This appeal decision provides an example of where it was concluded that a particular elevation does “front” a highway, even though there’s a significant angle between the elevation and the highway.
    [Note: The angle is approx 47 degrees].
  • This appeal decision provides an example of where an Inspector specifically disagrees with the advice within the DCLG “Permitted development rights for householders - Technical Guidance” document. [Note: In this particular case, the Inspector does not refer to a court judgment to support the contrary interpretation]. (*)
