The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 7 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
July 2017 - Code a00853 (appeal dismissed):
- Where the original house has a pitched or hipped roof, then it is not possible for an extension with a crown roof (i.e. a roof with a flat area in the centre and pitches at the sides) or similar (i.e. a pitched roof with a similar flat area) to comply with A.3(c). (*)
[Note: The extension has two hipped roofs, which would be joined by a flat area (a valley gutter with width approx 0.3m)].
July 2017 - Code a00852 (appeal dismissed):
- Where the walls of an outbuilding are not within 2m of a boundary, but the eaves / guttering / soffit / fascia / etc of the outbuilding overhang this line, then the 2.5m height limit of E.1(e) does apply. (*)
[Note: The eaves overhang this line by approx 0.07m]. - Where part of an outbuilding is within 2m of a boundary, then the 2.5m height limit of E.1(e) applies to the entire outbuilding (i.e. not only to that part of the outbuilding that’s within 2m of the boundary). (*)
