The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 6 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
March 2018 - Code a00918 (appeal dismissed):
- Where a proposed extension (under Class A) would be attached to an existing extension, then the phrase “[the] total enlargement” applies to the combined structure. [Note: In other words, the combined structure should be assessed against those limitations and conditions of Class A that apply to “[the] total enlargement”].
[Note: Relates to Part 1 Class A paragraph A.1(ja) (with respect to A.1(e)) of the GPDO 2015]. - Furthermore, the above conclusion still applies even if the existing extension was granted planning permission by the LPA (i.e. rather than erected under government permitted development rights).
[Note: Relates to Part 1 Class A paragraph A.1(ja) (with respect to A.1(e)) of the GPDO 2015].
March 2018 - Code a00917 (appeal dismissed):
- This appeal decision provides an example of where it was concluded that particular works do not fall within the scope of Class B, on the basis that the works exceed what constitutes “the enlargement of a dwellinghouse consisting of an addition or alteration to its roof”. (*)
[Note: The works include alterations to the existing firewalls].
[Quote: “In this case, I find that both elements of the overall roof extension which would seek to build up the party walls would not be additions or alterations to the roof of the property. They would principally be additional storeys of the property and would therefore comprise the enlargement, improvement or other alteration of a dwellinghouse within the ambit of Class A and not wholly within Class B. A single extension or alteration can fall within more than one Class. This extension scheme needs to be considered in the light of Class A as well as Class B.”].
