“Part 1 of the GPDO – GENERAL Appeal Decisions” – 6 additional appeal decisions (total = 1,054) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 6 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

June 2018 - Code a00948 (appeal allowed):

  • The term “eaves” does not apply to the edge of the flat area within a crown roof (i.e. a roof with a flat area in the centre and pitches at the sides).
  • Where the original house has a pitched or hipped roof, then it is possible for an extension with a crown roof (i.e. a roof with a flat area in the centre and pitches at the sides) or similar (i.e. a pitched roof with a similar flat area) to comply with A.3(c). (*)

June 2018 - Code a00947 (appeal dismissed):

  • An application under section 192 (proposed) should be assessed on the basis of the hypothetical works that are shown on the submitted drawings (i.e. rather than the actual works that have been carried out on the site). (*)
  • Where part of an extension is within 2m of a boundary, then the 3m eaves height limit of A.1(i) applies to the entire extension (i.e. not only to that part of the extension that’s within 2m of the boundary). (*)
