The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
September 2018 - Code a00972 (appeal dismissed):
- Where the rear wall of an extension complies with the 3m/4m rear projection limit of A.1(f), but the eaves / flat roof / guttering / soffit / fascia / etc of the extension overhang this line, then this is not permitted development. (*)
[Note: The flat roof overhangs this line by approx 0.6m].
August 2018 - Code a00971 (appeal allowed):
- The phrase “the highest part of the ... roof” relates to the property as a whole (i.e. not only to the part of the property that’s being altered or enlarged). (*)
- Where a property has an existing (non-original) roof extension that’s higher than the main roof, then “the highest part of the existing roof” is the highest part of this roof extension (i.e. rather than the highest part of the main roof).
[Note: The existing rear dormer is higher than the main ridge-line, and the Inspector concludes that “the highest part of the existing roof” is the flat roof of this rear dormer]. - For example, in such a situation, B.1(b) does allow a proposed roof extension to be higher than the highest part of the main roof (i.e. so long as the proposed roof extension is not higher than the highest part of the existing roof extension).
[Note: The proposed roof extension would replace the existing roof extension].
