The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 3 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
November 2018 - Code a00997 (appeal dismissed):
- This appeal decision provides an example of where the submitted information contained inconsistencies (or similar), and the Inspector concluded that an LDC should not be refused on this basis.
[Note: The Inspector states that the existing raised parapet walls “extend above the roofline to a greater degree than is shown on the submitted plans”]. - For a property with a pitched or hipped roof, “the highest part of the ... roof” is the main ridge-line (i.e. it does not include raised parapet walls or chimneys).
- Where the roof of a property has raised parapet walls (i.e. along the line of the party walls between the application site and the adjoining properties), then the building up on top of these raised parapet walls does not fall within the scope of Class B. (*)
[Quote: “In other words, the two side walls amount to part of the framework of the building to which the roof is attached. I am not convinced that they form part of the roof. Consequently, an extension which builds on top of those side walls would amount to an upward extension of the dwelling itself and not just an alteration or extension to the roof. In which case, the Council was correct to consider it under Class A.”].
