The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
November 2018 - Code a01001 (appeal dismissed):
- This appeal decision provides an example of the types of factors that should be taken into consideration when determining which elevation is “the principal elevation”.
- “The principal elevation” is not necessarily the elevation that fronts a highway.
- More than one wall facing the same direction can form “the principal elevation” (in the case where the elevation is staggered horizontally). (*)
- This appeal decision provides an example of where it was concluded that a wall that’s significantly set back from a forward projection of the property does form part of “the principal elevation”.
[Note: The wall is set back by approx 6.2m].
November 2018 - Code a01000 (appeal allowed):
- This appeal decision provides an example of where it was concluded that a particular structure does not constitute a “verandah, balcony or raised platform”. [Note: In other words, such a structure is not prevented by the limitations about balconies (i.e. A.1(k), B.1(e), and E.1(h))].
[Conclusion: The flat roof of a car port, with area more than 100m2, without a balustrade, and not accessible from an existing platform due to the railings of the latter, is NOT a “raised platform”].
