The Part 1 of the GPDO - INCIDENTAL Appeal Decisions document has been updated to include 5 additional appeal decisions relating to the "incidental" requirement of Part 1 Class E, for which the conclusions (short version) are as follows:
June 2019 - Code b00323 (NOT incidental):
- Outbuilding (total area 60m2) containing garden room / gym (40m2), and garden store (15m2).
June 2019 - Code b00322 (INCIDENTAL):
- Outbuilding (total area 55m2) containing play room (18m2), gym (15m2), changing room (5m2), shower room (3m2), jacuzzi (3m2), and boiler room (1m2).
- Note: The proposed swimming pool would be open-air, rather than enclosed by a building.
June 2019 - Code b00321 (NOT incidental):
- Outbuilding (total area 46m2) containing gym (15m2), play room (15m2), and WC (3m2).
June 2019 - Code b00320 (INCIDENTAL):
- Outbuilding 1 (total area 120m2) containing workshop (57m2), store room for a collection of cars and motorcycles (56m2), and WC (2m2).
- Outbuilding 2 (total area 120m2) containing home cinema (51m2), gym (46m2), sauna (7m2), shower room (with WC) (6m2), and cloak room (with WC) (3m2).
- Outbuilding 3 (total area 120m2) containing snooker room + bar + wine cellar (59m2), play room (51m2), and WC (3m2).
May 2019 - Code b00319 (NOT incidental):
- Outbuilding (total area 30m2) containing gym / store room (26m2), and shower room (with WC) (4m2).
