“Part 1 of the GPDO – INCIDENTAL Appeal Decisions” – 11 additional appeal decisions (total = 347) …

The Part 1 of the GPDO - INCIDENTAL Appeal Decisions document has been updated to include 11 additional appeal decisions relating to the "incidental" requirement of Part 1 Class E, for which the conclusions (short version) are as follows:

January 2020 - Code b00347 (INCIDENTAL):

  • Outbuilding (total area 42m2) containing store / garden room / art studio.

December 2019 - Code b00346 (NOT incidental):

  • Outbuilding (total area 70m2) containing fitness suite (70m2).
  • Note: The Inspector dismissed the appeal on the basis that "the Existing Fitness Suite [46m2] has not been demolished and there is no mechanism currently in place to ensure that it would be demolished prior to building the [proposed] Fitness Suite [70m2]".

December 2019 - Code b00345 (INCIDENTAL):

  • Outbuilding (total area 43m2) containing gym / home office (32m2), and store room (6m2).

December 2019 - Code b00344 (INCIDENTAL):

  • Outbuilding (total area 62m2) containing garage / store room (62m2).

December 2019 - Code b00343 (INCIDENTAL):

  • Outbuilding (total area 45m2) containing office / gym / entertainment room (32m2), garden store (5m2), and shower room (with WC) (4m2).

December 2019 - Code b00342 (NOT incidental):

  • Outbuilding 1 (total area 166m2) containing workshop (126m2), and storage room (40m2).
  • Outbuilding 2 (total area 147m2) containing gym (123m2), and storage room (24m2).
  • Outbuilding 3 (total area 162m2) containing studio (122m2), and storage room (40m2).
  • Outbuilding 4 (total area 166m2) containing painting studio (126m2), and storage room (40m2).

November 2019 - Code b00341 (INCIDENTAL):

  • Outbuilding (total area 25m2) containing gym (25m2).
  • Note: The (maximum) length of the outbuilding is shown as 4.1m on one drawing but 3.4m on another drawing.
  • Note: When assessing the structure against the "incidental" requirement of Part 1 Class E, the Inspector does not give significant weight to the fact that the structure would be separated from the main house by a relatively small gap (approx 0.07m (as stated by the Inspector) or 0.035m (as shown by the submitted drawings)).

November 2019 - Code b00340 (INCIDENTAL):

  • Outbuilding (total area 132m2) containing swimming pool + changing area + shower room + plant room + link corridor (111m2), and garage (21m2).

November 2019 - Code b00339 (INCIDENTAL):

  • Outbuilding (total area 78m2) containing gym / snooker room / home office (74m2), and shower room (with WC) (3m2).

November 2019 - Code b00338 (INCIDENTAL):

  • Outbuilding (total area 93m2) containing gym / snooker room (89m2), and shower room (with WC) (3m2).

November 2019 - Code b00337 (NOT incidental):

  • Outbuilding (total area 64m2) containing gym (64m2).
