The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
April 2020 - Code a01159 (appeal allowed):
- This appeal decision provides an example of where a property has a relatively minor roof that’s higher than the main roof, and the Inspector concluded that this relatively minor roof does constitute “the highest part of the ... roof”.
[Note: The minor roof is the roof of a raised structure (with area approx 5m2) that encloses a staircase (that provides access onto the main flat roof to form a roof terrace)].
April 2020 - Code a01158 (appeal dismissed):
- This appeal decision provides an example of where it was concluded that a particular piece of land is not within the “curtilage” of the property.
[Note: The land is approx 23m from the main house and separated from the main house by a shared garden (in different ownership) and a stone wall].
