“Part 1 of the GPDO – GENERAL Appeal Decisions” – 8 additional appeal decisions (total = 1,323) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 8 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

September 2020 - Code a01217 (appeal dismissed):

  • This appeal decision provides an example of where it was concluded that a particular structure (or particular works) should be assessed against Class A (i.e. rather than Class D).
    [Note: The structure would be added onto the front of an original single storey attached garage (which would be converted into “a storage/sports store”)].
    [Quote: “The term “porch” is not defined in the GPDO and it is therefore appropriate to apply a normal meaning. The existing enclosed glazed area that provides shelter outside the main door to the dwelling, which provides access to the habitable rooms within it, to my mind, is a “porch”. The Council refer to a “primary route of entry” in their reason for refusal. However, there is no such reference to a “primary route of entry” in the GPDO. As the drawings indicate, the garage is served by double doors and there is no proposed internal access between the storage/sports store and the rest of the dwelling. Consequently, the double doors would only provide access to the storage/sports store and no other parts of the dwelling. As they provide no access to any of the habitable areas of the dwelling, I do not consider that the double doors satisfy the meaning of an “external door of a dwellinghouse”. Therefore, for the purposes of the GPDO, the proposed works do not amount to the erection or construction of a porch outside any external door of a dwellinghouse. As such, it does not meet the requirements of Class D.”].

September 2020 - Code a01216 (appeal dismissed):

  • This appeal decision provides an example of where it was concluded that a proposed roof extension (under Class B) should not be treated as two separate proposed roof extensions (under Class B) for the purposes of the phrase “the enlargement” within B.2(b). [Note: In other words, the combined structure should be assessed against those limitations and conditions of Class B that apply to “the enlargement”]. (*)
    [Note: Relates to an “L”-shaped roof extension (or similar), and the Inspector refers to "one single enlargement"].
    [Quote: “The ‘L’ shaped dormer proposed is one single enlargement flowing from the main roof to the roof of the outrigger. It clearly joins the main roof of the house to the roof of the outrigger.”].
  • This appeal decision provides an example of where it was concluded that significant weight should be attached to the advice within the “Permitted development rights for householders - Technical Guidance” document. (*)
  • This appeal decision provides an example of where it was concluded that a particular roof extension does constitute “an enlargement which joins the original roof to the roof of a rear or side extension” for the purposes of B.2(b). (*)
    [Note: The proposed roof extension would join the main rear roof onto the pitched roof of the original two-storey rear projection].
