The Part 1 of the GPDO - INCIDENTAL Appeal Decisions document has been updated to include 6 additional appeal decisions relating to the "incidental" requirement of Part 1 Class E, for which the conclusions (short version) are as follows:
April 2021 - Code b00426:
- Outbuilding (total area 148m2) containing entertainment room (snooker table + craft studio + home cinema) (55m2), gym (39m2), and home office (30m2).
- Conclusion: INCIDENTAL
March 2021 - Code b00425:
- Outbuilding (total area 28m2) containing home office (22m2), and WC (2m2).
- Conclusion: INCIDENTAL
March 2021 - Code b00424:
- Outbuilding 1 (total area 17m2) containing gym (16m2).
- Outbuilding 2 (total area 6m2) containing storage room (5m2).
- Note: When assessing the 2 x structures against the "incidental" requirement of Part 1 Class E, the Inspector does not give significant weight to the fact that the 2 x structures would be separated from the main house by a relatively small gap (approx 0.05m).
- Conclusion: INCIDENTAL
March 2021 - Code b00423:
- Outbuilding (total area 93m2) containing garage for classic vehicles (83m2).
- Note: This would be in addition to an existing "double garage on the site, which is temporarily being used as a residence".
- Conclusion: INCIDENTAL
March 2021 - Code b00422:
- Outbuilding (total area 90m2) containing gym (36m2), hot tub room (16m2), plant room (6m2), sauna (6m2), steam room (6m2), and changing / shower room (with WC) (6m2).
- Conclusion: INCIDENTAL
March 2021 - Code b00421:
- Outbuilding (total area 106m2) containing gym (44m2), art studio (38m2), store room (4m2), and shower room (with WC) (3m2).
- Note: The Inspector allowed the appeal on the basis that "The drawings provided show that it is proposed to demolish the existing storage shed [55m2] and art studio [38m2]".
- Conclusion: INCIDENTAL
