The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

October 2021 - Code a01346 (appeal dismissed):

  • This appeal decision provides an example of where it was concluded that a particular piece of land is not within the “curtilage” of the property.
    [Note: The land is “currently owned by the Council”, and is approx 3m-12m from the main house and separated from the main house by a hedge].

October 2021 - Code a01345 (appeal allowed):

  • Where a property has an existing (non-original) extension with a roof that joins onto the roof of the main house, then this existing extension does not reduce the volume (i.e. “cubic content”) that remains under B.1(d) for further extensions. (*)
    [Note: The existing extension has a dual-pitched roof (containing a habitable room with 3 rooflights) that joins onto the dual-pitched roof of the main house (albeit without an internal door at this roof level). The Inspector concluded that this existing extension does not reduce the volume that remains under B.1(d), on the basis that this existing extension is “an extension with a roof, as opposed to being an enlargement to roof space”].
