“Part 1 of the GPDO – GENERAL Appeal Decisions” – 4 additional appeal decisions (total = 1,483) …

The Part 1 of the GPDO - GENERAL Appeal Decisions document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

January 2022 - Code a01377 (split decision):

  • Where a property has a secondary roof that’s slightly lower than the main roof, then an extension on top of this secondary roof should be assessed against Classes A and B. (*)
    [Note: The secondary roof is the roof of a non-original single storey rear extension on a single storey house].
  • This appeal decision provides an example of where it was concluded that the roof pitch of the extension is not the same as the roof pitch of the original house.
    [Note: The extension has a flat roof, and the roof pitch of the main house is approx 38 degrees].

January 2022 - Code a01376 (appeal dismissed):

  • This appeal decision provides an example of where it was concluded that works involving a slight excess beyond one of the limitations or conditions are not permitted development (i.e. the Inspector didn’t refer to the excess as “de minimis” or similar). (*)
    [Note: 2.526m height exceeds 2.5m limit (i.e. by 1.0%)].
    [Note: Relates to E.1(e) of the GPDO 2015].
