The "GPDO Part 1 Class E (Incidental Requirement) - LDC Appeal Decisions" document has been updated to include 4 additional appeal decisions relating to the "incidental" requirement of Part 1 Class E, for which the conclusions (short version) are as follows:
July 2022 - Code b00490:
- Outbuilding (total area 49m2) containing storage room (45m2).
- Note: This would be in addition to an existing outbuilding containing storage.
- Conclusion: NOT incidental
July 2022 - Code b00489:
- Outbuilding (total area 99m2).
- Note: The Inspector states "No evidence as to why the outbuilding was required was put forward at the application stage", and states that "In his Statement of Case [at the appeal stage], the Appellant sets out a range of uses that the outbuilding might be put to", albeit that "whilst he says that these would be incidental uses, he provides no reasoning as to the requirement for the outbuilding".
- Conclusion: NOT incidental
July 2022 - Code b00488:
- Outbuilding (total area 76m2) containing garage + workshop area + garden store (62m2), and log store (4m2).
- Conclusion: INCIDENTAL
July 2022 - Code b00487:
- Outbuilding containing garage for a collection of 5 racing and seasonal use vehicles + workshop area, open store for vehicles, garden and maintenance equipment storage, 2 x offices, green house + potting shed.
- Conclusion: INCIDENTAL
