The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

October 2022 - Code a01480 (appeal dismissed):

  • This appeal decision provides an example of where it was concluded that a particular piece of land is within the “curtilage” of the property.
    [Note: The land is approx 6m-17m and 17m-31m from the main house].
  • This appeal decision provides an example of where the applicant submitted (or offered to submit) an amended drawing during the appeal process, and the Inspector did not accept this amended drawing. (*)
    [Quote: “[The applicant] accepted that the height of part of the proposed ‘L’ shaped building would be higher than 2.5m within 2m of the boundary, (the edge of the redefined curtilage). Consequently, the appeal project would not comply with limitation E.1(e)(ii) of the Order. [The applicant] said the drawings could be revised and agreed. However, I can only consider the details before me. There is no equivalent power to that set out under s.191(4) of the Act for the Local Planning Authority, Secretary of State or Inspector to modify the terms of a lawful development certificate application made under s.192 of the Act.”].
  • Where development is undertaken as a single operation, then it is not possible for only part of the development to be permitted development (i.e. either the entire development is permitted development, or none of the development is permitted development). (*)

October 2022 - Code a01479 (appeal allowed):

  • This appeal decision provides an example of where it was concluded that it is not necessary for the materials used for the new works to be “of a similar appearance” to the materials used on the same level of the existing house (i.e. it is sufficient to be similar to the materials used on a different level of the existing house). (*)
    [Conclusion: The ground floor front wall of a side extension can be similar to the first floor front wall (and the ground and first floor side and rear walls) of the main house].
