“GPDO Part 1 (All Classes) – LDC Appeal Decisions” – 3 additional appeal decisions (total = 1,601) …

The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 3 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

November 2022 - Code a01495 (appeal dismissed):

  • This appeal decision provides an example of where an application under section 191 (existing) was assessed on the basis of the actual works that have been carried out on the site (i.e. rather than the hypothetical works that are shown on the submitted drawings). (*)
  • Where a property has a secondary roof that’s significantly lower than the main roof, then an extension on top of this secondary roof should be assessed against either Class A or Class B. (*)
    [Note: The secondary roof is the roof of an original single storey rear projection on a two-storey house].
  • The term “eaves” does apply to the edge of a flat roof. (*)
  • Where a proposed first floor extension would be on top of an original ground floor projection, then “the enlarged part of the dwellinghouse” has “more than a single storey” / “more than one storey” (i.e. rather than “a single storey”). (*)
    [Note: Relates to A.1(h) of the GPDO 2015].
  • In the first of the above diagrams, (at least) part of “Roof Extension C” “extends beyond” the outside face of “Wall 1” (i.e. for the purposes of B.2(b)(ii)). [Note: The diagrams are viewable within the “Extend beyond” topic of this document]. (*)
    [Conclusion: The roof extension does not comply with B.2(b)(ii) for the above reason].
    [Note: The gap between the roof extension and “Wall 1” is 0m (i.e. no gap)].
  • This appeal decision provides an example of where it was concluded that a particular roof extension does not constitute “an enlargement which joins the original roof to the roof of a rear or side extension” for the purposes of B.2(b). (*)
    [Note: The proposed roof extension on the original single-storey rear projection would join onto the gable end of the dual-pitched roof of the main house].
