The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 3 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
February 2023 - Code a01525 (appeal dismissed):
- The height of a structure should be measured from the highest part of the adjacent ground level (i.e. rather than from each part of the adjacent ground level). (*)
[Note: The structure is an extension]. - When measuring the height of a structure, “ground level” excludes any artificial structure (e.g. patio, decking, etc) on top of the ground.
[Note: The artificial structure is a patio].
[Note: The Inspector states that “the development would realistically involve the removal of the patio”].
