The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
May 2023 - Code a01556 (appeal allowed):
- The conditions about materials (i.e. A.3(a) and B.2(a)) do not affect the extent to which an elevation is glazed. (*)
[Note: This appeal decision implies (rather than states) this conclusion].
[Note: The face of the rear dormer would be mostly glazed, containing a set of folding/sliding glazed doors (and windows). Each of the cheeks of the rear dormer would be mostly glazed, containing a triangular-shaped window].
[Quote: “A flat roof dormer would be installed across the width of the rear roof slope of the main roof and would be fully glazed. Glazing to each end would be non-opening and frosted and all new materials would match the existing house. [...] The plans show that the glazing would be similar in style to the windows in the rear elevation of the existing house and the Juliet balcony would provide a safety bar and not a platform and therefore no external access. On the evidence available to me I find, as a matter of fact and degree and on the balance of probabilities, the proposed loft conversion would be permitted by Class B and Class C, Part 1 of Schedule 2 of the GPDO and express planning permission would not be required.”]. - A “juliette balcony” without a platform does not constitute a “verandah, balcony or raised platform”. [Note: In other words, such a structure is not prevented by the limitations about balconies (i.e. A.1(k), B.1(e), and E.1(h))].
[Note: This appeal decision implies (rather than states) this conclusion]. - This appeal decision provides an example of where it was concluded that a particular roof extension does constitute “a hip-to-gable enlargement” for the purposes of B.2(b). (*)
[Note: This appeal decision implies (rather than states) this conclusion].
[Note: The existing roof has 2 x half-hip / barn hip ends (one on each side), and the resulting roof is 2 x gable ends].
