“GPDO Part 1 (All Classes) – LDC Appeal Decisions” – 5 additional appeal decisions (total = 1,687) …

The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

July 2023 - Code a01581 (appeal dismissed):

  • More than one roof slope facing the same direction can form “the principal elevation”. (*)
  • This appeal decision provides an example of where it was concluded that a wall that’s significantly set back from a forward projection of the property does form part of “the principal elevation”. (*)
    [Note: The wall is set back by approx 3.7m].
  • This appeal decision provides an example of where it was concluded that a roof slope that’s significantly set back from a forward projection of the property does form part of “the principal elevation”. (*)

  • In the first of the above diagrams, “Roof Extension B” does not comply with B.1(c). [Note: The diagrams are viewable within the “Extend beyond” topic of this document]. (*)

July 2023 - Code a01580 (appeal allowed):

  • It is possible to issue an LDC under section 192 (proposed) for a larger rear extension (i.e. if the developer has successfully completed the prior approval process). (*)
    [Quote: "In this case, an application was made for prior approval of a single storey rear extension projecting 6 metres from the rear wall of the house under reference 22/01165/GPDO. The application form is dated 18 March 2022. The Council’s decision notice states that the application was received on 22 March 2022. The Council issued a decision on 16 May 2022, stating that as the local planning authority, it has ‘resolved prior approval no jurisdiction’. It is not clear what the decision was intended to signify, as it does not state whether prior approval is required, given or refused. In any event, it was dated after the expiry of 42 days following 22 March 2022. Therefore, the condition in paragraph A.4 has been complied with. On the basis of the information before me, I have no reason to differ from the view of both parties that the extension would benefit from the permitted development rights set out in Class A of Part 1 Schedule 2 of the GPDO, and was therefore lawful at the date of application."].
