The "GPDO Part 1 Class E (Incidental Requirement) - LDC Appeal Decisions" document has been updated to include 9 additional appeal decisions relating to the "incidental" requirement of Part 1 Class E, for which the conclusions (short version) are as follows:
September 2023 - Code b00532:
- Outbuilding (total area 75m2) containing gym + games room (41m2), home office (16m2), and shower room (with WC) (4m2).
- Conclusion: INCIDENTAL
September 2023 - Code b00531:
- Outbuilding (total area 180m2) containing gym + games room (81m2), garage (33m2), store room (33m2), sauna / steam room (4m2), and shower room (with WC) (3m2).
- Conclusion: INCIDENTAL
September 2023 - Code b00530:
- Outbuilding containing garage / store.
- Note: When assessing the structure against the "incidental" requirement of Part 1 Class E, the Inspector does give significant weight to the fact (or assertion) that it would be relatively difficult (or impossible) for vehicles to access the garage.
- Conclusion: NOT incidental
August 2023 - Code b00529:
- Outbuilding (total area 105m2) containing games / garden room (54m2), gym (26m2), 2 x home offices (13m2), and shower room (with WC) (8m2).
- Conclusion: NOT incidental
August 2023 - Code b00528:
- Outbuilding (total area 70m2) containing gym + home office (41m2), WC (4m2), plant room (4m2), and changing room (2m2).
- Note: The proposed swimming pool would be open-air, rather than enclosed by a building (and is the subject of a separate application).
- Conclusion: INCIDENTAL
August 2023 - Code b00527:
- Outbuilding (total area 50m2) containing store, games area, and hobby workshop.
- Note: When assessing the structure against the "incidental" requirement of Part 1 Class E, the Inspector does give significant weight to the fact that the lower part of the south-west wall of the outbuilding would be relatively thick (approx 0.8m) in an attempt to make the outbuilding "immediately adjacent" to a particular piece of ground (i.e. the highest ground level on the site).
- Conclusion: NOT incidental
August 2023 - Code b00526:
- Outbuilding (total area 71m2) containing gym (19m2), play room (19m2), home office (7m2), and WC (3m2).
- Conclusion: INCIDENTAL
August 2023 - Code b00525:
- Outbuilding (total area 129m2) containing gym (41m2), play room (41m2), home office (10m2), and WC (4m2).
- Conclusion: INCIDENTAL
July 2023 - Code b00524:
- Outbuilding (total area 56m2) containing gym + sink + bar area (18m2), spa (14m2), garden tools store (6m2), and shower room (with WC) (4m2).
- Conclusion: NOT incidental
