The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 2 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
October 2023 - Code a01610 (appeal allowed):
- This appeal decision provides an example of where it was concluded that particular works do fall within the scope of Class E, on the basis that the works do not exceed what constitutes “The provision within the curtilage of the dwellinghouse of [an outbuilding etc] ... or the maintenance, improvement or other alteration of such [an outbuilding etc]”.
[Note: The works include the “Erection of a 5x3 meter Shed”, “Minor ground works in levelling out”, the “Laying of a steel mesh reinforced concrete slab 3 meters by 5 meters and 75mm thick”, and the installation of “A french drain ... around the slab”].
[Quote: “Having regard to the prohibitions and restrictions of Class E, found in paragraphs E.1, E.2 and E.3 of the 2015 Order, none appear relevant to the proposal. The proposed shed would be situated to the rear of the dwellinghouse; would consist of one storey; and would be 2.5m at its maximum height, as depicted in drawing number 002. It would not occupy an excessive amount of the curtilage, as depicted in drawings 001 REV A and 003. The preparatory works as described in the application all appear to me reasonably necessary and incidental to the provision of the shed itself, and hence the works as a whole benefit from the permission conferred by the 2015 Order. The information supplied by the appellant has not been disputed by the Council and it is sufficient to demonstrate, on the balance of probabilities, that the proposed works benefit from planning permission. Hence a certificate will be issued.”].
