New Legislation – relating to the National Health Service Commissioning Board, including consequential amendments to the DMPO 2015 and other planning legislation (06/11/2023) …

The following 1 new Statutory Instrument (SI) comes into force on 06/11/2023:

New Legislation:

  • November 2023: SI 2023 No. 1071 - The Health and Care Act 2022 (Further Consequential Amendments) (No. 2) Regulations 2023 (pdf) (link).

Notes:

  • The above SI 2023 No. 1071 includes consequential amendments to the following SIs:
    - The DMPO 2015 (i.e. The Town and Country Planning (Development Management Procedure) (England) Order 2015).
    - The Local Planning Regulations 2012 (i.e. The Town and Country Planning (Local Planning) (England) Regulations 2012.
    - The Neighbourhood Planning (General) Regulations 2012.
    - The Infrastructure Planning (Applications: Prescribed Forms and Procedure) Regulations 2009.
    - The Infrastructure Planning (Changes to, and Revocation of, Development Consent Orders) Regulations 2011.
    - The Infrastructure Planning (Compulsory Acquisition) Regulations 2010.
    - The Infrastructure Planning (Interested Parties and Miscellaneous Prescribed Provisions) Regulations 2015.
  • In particular, regulations 39, 43, and 50 of the above SI 2023 No. 1071 replace definitions of the "National Health Service Commissioning Board" with definitions of "NHS England". Furthermore, the Schedule of the above SI 2023 No. 1071 replaces references to "The National Health Service Commissioning
    Board"
     / "The Board" / "The NHSCB"
    (or similar) with references to "NHS England" (or similar).
  • The "Explanatory Note" (link) at the end of the above SI 2023 No. 1071 includes the following information:
    - "These Regulations [SI 2023 No. 1071] make further amendments which are consequential on the Health and Care Act 2022 ("the 2022 Act").".
    - "Part 2 [of SI 2023 No. 1071] makes amendments which are consequential on the National Health Service Commissioning Board being renamed to NHS England (see section 1 of the 2022 Act).".
    - "Part 3 [of SI 2023 No. 1071] makes amendments which are consequential on the establishment of integrated care boards and the abolition of clinical commissioning groups (see section 19 of the 2022 Act).".
