The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 3 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

October 2023 - Code a01614 (appeal allowed):

  • This appeal decision provides an example of where it was concluded that a particular hard surface should be assessed against Class F (i.e. rather than Class A or Class E).
    [Note: This appeal decision implies (rather than states) this conclusion].
    [Note: The surface is porous block paving].
  • This appeal decision provides an example of where the Inspector (specifically) concluded that F.2 requires either 1) the hard surface is made of porous materials, or 2) provision is made to direct run-off water from the hard surface to a permeable or porous area or surface within the curtilage of the dwellinghouse. [Note: In other words, F.2 does not require both 1) and 2)].
    [Quote: “The Council suggests that the hardstanding may not have been permitted development. There is no LDC before me for those works. However, the sole basis of the Council’s view appears to be the condition at F.2. of Class F. This establishes that, for a hardstanding such as this, it is conditional that either the hard surface is made of porous materials, or provision is made to direct run-off water from the hard surface to a permeable or porous area or surface within the curtilage of the dwellinghouse. Yet the Council accepts that the hardstanding is made of porous materials. Consequently, regardless of any provision made for directing water run-off, the evidence before me suggests that the condition is complied with. The Council does not suggest that there is non-compliance with any other aspect of Class F. Accordingly, I have no reason to doubt that the hardstanding was development permitted under Class F.”].
