The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 2 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

December 2023 - Code a01629 (appeal allowed):

  • For an application under section 191 (existing), if works that are permitted development had been carried out by the time of the application, but then (subsequently) another set of works that are not permitted development have been carried out by the date the application is determined, then the application should be assessed on the basis of only the former works. (*)
    [Note: It appears that the Inspector assesses the application on the assumption that by the time of the application the works had been substantially completed as shown on the submitted drawings, but then (subsequently) the works were altered as shown in the photos].
  • This appeal decision states, or implies, that where a roof extension involves building up the flank wall(s) of the main house (e.g. a hip-to-gable roof extension, or a full-width rear dormer, etc), then it is possible for the materials used for the flank wall(s) of the roof extension to be “of a similar appearance” to the walls of the existing house.
