“GPDO Part 1 (All Classes) – LDC Appeal Decisions” – 3 additional appeal decisions (total = 1,795) …

The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 3 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

June 2024 - Code a01689 (appeal allowed):

  • The height of a structure should be measured from the highest part of the adjacent ground level (i.e. rather than from each part of the adjacent ground level). (*)
    [Note: The structure is an outbuilding].
  • This appeal decision provides an example of where it was concluded that a structure is “immediately adjacent” to a particular piece of ground.
    [Conclusion: The landing area in the south-east corner of the outbuilding (which is inside the south side wall of the outbuilding and underneath the flat roof of the outbuilding) is immediately adjacent to the ground level next to the west end of the outbuilding (on the basis that “The external landing would be an integral part of the building”)].
    [Quote: “As noted above, the highest part of the ground level next to the building, at the [west] end furthest from the river, is at the floor level of the building. This is the same height as the external landing. The development proposed in this case is the whole building. The external landing would be an integral part of the building. As the relevant Technical Guidance refers to the ‘building’, and the interpretation of ‘height’ and ‘raised’ are within the General Issues section, rather than being particular to the interpretation of Class E, or paragraph E.1.(h), I find that the height of any raised platform in this case should also be measured from the highest part of the ground adjacent to the building. That height would not be exceeded by any part of the proposal that could be deemed a raised platform.”].
