The "GPDO Part 1 Class E (Incidental Requirement) - LDC Appeal Decisions" document has been updated to include 5 additional appeal decisions relating to the "incidental" requirement of Part 1 Class E, for which the conclusions (short version) are as follows:

May 2024 - Code b00555:

  • Outbuilding (total area 123m2) containing garage (41m2), gym (36m2), store room (18m2), and office (13m2).
  • Conclusion: INCIDENTAL

May 2024 - Code b00554:

  • Outbuilding (total area 7m2) containing storage room (6m2).
  • Note: When assessing the structure against the "incidental" requirement of Part 1 Class E, the Inspector does give significant weight to his conclusion that "In my view, the design and siting illustrate the purpose for which the shed was provided, which was to essentially block views from the kitchen window at [the neighbouring property to the north-west side], in an attempt to overcome the Council’s only reason for refusing permission for a dwelling on the land".
  • Conclusion: NOT incidental
